Is it in the State Constitution? Is there a statute? Can they cite it? Does the statute actually grant this authority? If it does, where did the State Constitution authorize the State Legislature to make such a law? Otherwise, this use of executive order is illegal, not to mention Unconstitutional at both the State and National Constitutional level.
