The operative word here is "LAWFULLY"!!!
To LAWFULLY detain an individual a #Police Officer needs "Probable Cause" that the individual HAS, IS ABOUT TO, or IS IN COMMISSION OF A CRIME!!!
The Law Enforcement Officer MUST be able to ARTICULATE clearly why he believes the individual HAS, IS ABOUT TO COMMIT, or IS IN COMMISSION OF A CRIME to have "Probable Cause" to detain someone "Lawfully" in Texas!!!
The Officer MUST "Lawfully Arrest" or "Lawfully detain" someone to require they provide ID!!!
"Failure to ID" is a SECONDARY CHARGE that REQUIRES an individual to be ARRESTED or "Lawfully Detained" in order to charge someone with "Failure to ID"
People MUST learn the LAW!!!
Police DON'T KNOW THE LAW, they abuse and misuse it to screw people over............. but very few actually KNOW THE LAWS they are charged with enforcing!!! It's PATHETIC!!!
